CONDITIONS OF USE OF THIS SITE

Buyers/users of our consent and agree that use of the site www.southeastarmory.com (Southern Armory LLC/dba Southeast Armory) constitutes a legally binding agreement to comply and be subject to our “Store Policies” (Terms and Conditions). IT IS YOUR RESPONSIBILITY TO READ THEM CAREFULLY AND MAKE SURE YOU UNDERSTAND PRIOR TO SUBMITTING AN ORDER. ONLINE INVENTORY, PRICING, AND POSSIBLE ERRORS

Our online inventory and pricing is available for online orders only. Online inventory and pricing does not represent our in-store inventory or pricing. Some items ship directly from our in-store inventory and some ship from our distributors’ warehouses.

 

We process orders in the order that we receive them. It is possible that an item could low in stock, and, because we receive multiple orders for that item in a short time frame, that an item may appear to be in stock online but be unavailable by the time your order is processed. If we are unable to fulfill your order due to this issue, we will promptly issue you a full refund. If your order includes multiple items, we will fulfill the in-stock portion and issue the refund for the out of stock items only.


As a user of our site, you acknowledge that occasionally there may be typographical errors, mistakes in descriptions, titles, product UPC, or inventory counts. We make our best effort to ensure accuracy, but Southeast Armory in no way guarantees there are no errors on this site.

 

Buyer and/or User of this site acknowledges and agrees that occasionally an item may appear on the site by mistake or the item(s) description and/or title may contain a typographical error. You are responsible for verifying pictures, descriptions, functions, specs, UPC numbers, etc., with the product manufacturer. Southeast Armory makes no warranties or guarantees against inaccuracies and discrepancies, and you agree that any such inaccuracies or discrepancies will require you to contact the product manufacturer to resolve. Southeast Armory will not accept returns or issue refunds due to any such inaccuracies. You agree that Southeast Armory will be the final arbiter of any disputes over any such discrepancies and deviations from this policy will be at the sole discretion of Southeast Armory.

ORDER FULFILLMENT & SHIPPING

We process orders every day in the order that they are received, usually within two business hours. Most of our orders are shipped direct from our distributors’ warehouses within 1 to 3 business days of processing.  Seasonal/holiday delays may occur when demand is high. Be aware that business days do not include holidays or weekends. We reserve the right to choose the shipping carriers and services provided based on distributor guidelines and availability.

 

Shipping insurance is available and covers orders that have been lost, damaged, or stolen while in transit. It is not mandatory to purchase shipping insurance, however, without it, you are agreeing to and assuming the risk of uncovered damages, losses, and/or theft. When using shipping insurance, you agree to be responsible for contacting the shipping vendor to file any claims.

 

 

ORDER CANCELLATION

Orders cannot be changed after they have been submitted. Requests to cancel orders must be sent to searmory@gmail.com. You can call to confirm receipt of the cancellation (678-948-6701) but the initial request must be writing via email. Orders are not considered cancelled unless/until you receive verification from us via email.

 

Cancelled orders are subject to the following fees:

  • Cancellation prior to order being processed: 10%
  • Cancellation after order has processed 20% AND original shipping costs and any return shipping costs or fees associated

No refunds, partial or whole, will be issued until any shipped merchandise is received as a return and processed.

 

YOUR RESPONSIBILITIES

  • You consent to all Terms and Conditions within this page.
  • You affirm that you are at least 18 years of age (or at least the legal age in your state) to purchase any item from this site.
  • You affirm that you are at least 18 years of age when purchasing shotgun or rifle ammunition, and at least 21 years of age when purchasing handgun ammunition.
  • You affirm that you are of legal age to own any items ordered from this site.
  • You agree that you are the actual Transferee/Buyer of firearm(s) or other items your order from our website.
  • You agree to provide valid contact information and consent to be contacted by us via provided methods (email, phone, shipping address)
  • You agree to provide any requested information (such as a copy of your Driver’s License) within two business days if requested by Southeast Armory.
  • You agree to follow all Federal, State, and local laws when ordering, using, or possessing any item ordered from our site.
  • You agree to make payment for your orders and not dispute any payments for any reason.

 

 

FIREARMS PURCHASE / SHIPPING

You understand that it is illegal to ship firearms to anyone not holding an active Federal Firearms License (FFL).

You can pick up firearms purchased on our website at our shop by appointment (202 Canton Road, #104, Cumming, GA 30040) or we can ship them to an FFL Dealer near you.

 

IT IS YOUR RESPONSIBILITY TO ENSURE THAT THE FFL YOU CHOOSE AT CHECKOUT:

- IS STILL IN BUSINESS,

- CAN AND WILL ACCEPT DROP SHIP ORDERS,

- CAN AND WILL ACCEPT THE SHIPMENT AT THE PREMISES ADDRESS ON THEIR FFL,

- CAN AND WILL ACCEPT AND PROCESS YOUR FFL TRANSFER

 

There may be circumstances when, at our discretion, we need to request an alternate FFL provider. This may be due to shipment restrictions or internal holds by our distributors. You understand and agree that it is your responsibility to provide us with an alternate FFL if we request one, for any reason.

 

You understand that firearm orders cannot ship without a copy of your chosen FFL provider’s license. We must receive a copy of the FFL license (not just the FFL number) within 5 days of the order submission. It is your responsibility to ensure that your chosen FFL sends a copy of their license to us at searmory@gmail.com. You understand and agree that your order will be cancelled and subject to the cancellation fee of 10% if we have not received a copy of your chosen FFL’s valid license before the end of business on the 5th day after you submit your order.

 

You further understand and acknowledge that it is your responsibility to ensure that the item you are ordering can be sent to your state, and that any orders that cannot be fulfilled due to Federal, State, or local laws are subject to cancellation and the cancellation fee of 10%.

 

AMMUNITION SALES

You affirm that you are 18 years of age or older when buying shotgun or rifle ammunition, and 21 years of age or older when buying handgun ammunition from us. Further, you acknowledge and agree that it is your responsibility to ensure you are purchasing the correct ammunition, that you are legally allowed to purchase and possess the ammunition, and that the ammunition can be shipped to you. Ammunition sales will be subject to the cancellation policy and cancellation fees if they cannot be fulfilled due to Federal, State, and/or local law. All Ammunition sales are final.

 

 

WARRANTY FOR NEW FIREARMS AND PRODUCTS

Most new firearms and products are have warranties by their manufactures. Southeast Armory makes no warranties and provides no repairs or replacements of any kind for any products sold on this site. When available, warranties, replacements, and repairs are by the manufacturer only. You understand and agree that you must make requests for any such service directly with the manufacturer. Southeast Armory does not accept returns.

RETURNS

All sales on this website are final. Most manufacturers offer replacement or repair on their products, and it is your responsibility to work directly with the manufacturer if a warranty issue arises. You acknowledge and agree that Southern Armory LLC dba Southeast Armory does not accept returns or issue refunds for any merchandise purchased at www.southeastarmory.com

USED FIREARMS

Used firearms are sold with no warranty or guarantee of any kind. Understand that new firearms become “used” as soon as they are transferred to you, even if they are unfired. All used firearms sales are final.

INDEMNIFICATION AGREEMENT

You acknowledge and agree that you are responsible for all representations made when ordering from this site and agreeing to the Terms and Conditions on this page. Buyer and/or User of his site acknowledges and agrees to be responsible for all representations made when making purchases under the Store Policies (Terms and Conditions) contained on this site. You agree to release, indemnify, and hold harmless Southeast Armory of any civil liability or criminal prosecution resulting from the product(s) you purchase from this site.

FAILED BACKGROUND OR FAILURE TO ACCEPT TRANSFER

You agree to accept transfer of firearms sent to us as your FFL dealer within 7 business days of our receipt of the firearm. Please contact us if you need to make other arrangements. Items that are not claimed within 7 days (without arrangements) and items that cannot be transferred due to a failed background check, will be returned. You are responsible for original shipping costs, return shipping charges, and a 20% re-stocking fee.

CREDIT / DEBIT CARD CHARGEBACKS

You acknowledge and agree that we will actively pursue any disputed card charges, credit card chargebacks (or any other charge to us in any other form) by us by collection and/or legal means.

 

You agree to the following for all credit card chargebacks or charges to us in any form:

Buyer and/or User of this site agrees that the following fees will be accessed on All Credit Card Chargebacks (or any other charge to us in any other form):

1. You agree to pay a fee of $25.00 per charge back

2. You agree to pay an administrative fee of $100 (or the maximum permitted by law)

3. You agree to repay the original charge back amount plus any recovery costs.

4. You further understand and agree that a charge back will result in order cancellation and is subject to the fees listed above as well as the 10% cancellation fee.

LEGAL MATTERS

Should any legal matters arise, you agree that Forsyth County, GA would have jurisdiction, and that you waive your right to a trial by jury. Furthermore, you agree to be responsible for any attorneys’ fees associated with the application of our policies, terms, and conditions related to your use of or purchases from our site.

 CHANGES TO STORE POLICIES (TERMS AND CONDITIONS)

Terms and conditions are subject to change, and the most current version will always be available on our site for your review. We reserve the right to change, update, remove, replace, or in other ways modify these terms at our sole discretion at any time. It is your responsibility to review them periodically. Usage of our site and ordering from us constitutes your agreement and acceptance of the policies contained on this page.
